De Morgan Foundation Online Sales and Refund Policy

 

By placing an order and confirming payment on the website of The De Morgan Foundation (DMF) you agree to contract with us in accordance with the following terms and conditions of sale.

· Goods and services
Every care has been taken to ensure accuracy of description, specifications, colour and price of all products. However, these may change due to circumstances beyond our control. Sizes are given as a guide only. Please be aware that handmade items (including reproduction tiles) are subject to variations in size, colour and shape owing to the unique nature of the product. If you are interested in ordering a large quantity of decorative tiles for interior use please contact us first so that we can ensure a matched batch is ordered from the supplier.
 

· Availability, prices and import duties
All items are offered for sale subject to availability. DMF regrets that occasionally it may be impossible to complete an order if stock runs out or is withdrawn for any reason. But if there is a problem we will let you know as soon as we can. The price of the goods shall be the price listed on our website on the date of your order, inclusive of any VAT which may be payable by you. All prices displayed on the website are quoted in UK Pounds Sterling and must be paid in full, including delivery charges (which are in addition to the item price). Customers and not the DMF are responsible for any applicable customs duties, taxes or currency conversion charges in their own country.
 

· Ordering 
By clicking the 'PURCHASE' button on the Confirm & Purchase Screen, you agree to these terms and conditions. By completing and submitting the electronic order form you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. You are responsible for ensuring the accuracy of your order and we shall supply you, subject to availability, with the quantity and specification of goods set out in your order. While your card may be debited before the contract is formed, if the order can not be fulfilled for any reason, a full refund will be made immediately. You have the right to cancel your order before dispatch or within seven days of receipt of the goods. Our return and refund procedures are outlined below.
 

· Payment 
Payment may be made by any of the methods indicated on our website. DMF does not offer any credit facilities, so we will not deliver goods to you if you do not pay for your order in full at the time of ordering. After processing your payment by credit card, we do not retain your details which means you will need to resubmit this information when you place a further order on this website.
 

· Delivery
Delivery shall be made to the delivery address supplied by you at the time of ordering. While we endeavour to deliver within the times specified, any times quoted for delivery are approximate only and DMF shall not be liable for any delay in delivery of the goods howsoever caused. Risk of damage to or loss of the goods shall pass to you at the time of delivery to the specified delivery address. In general we aim to dispatch goods within 10 working days, we thank you for your patience in this respect.
 

· Returns / Replacements / Shortfalls
We want you to be happy with your order. If you are not entirely satisfied with any item you received*, your order was incorrectly fulfilled, or contained damaged /  defective items and you require a refund / replacement please notify the DMF in writing at the address below within seven days of receipt of your order. If you fail to notify us within the allotted time period, we regret that you will be deemed to have accepted the goods. Damaged / unrequired items should then be returned to the DMF (in their original packaging and with all relevant documentation) within 28 days. Once we receive the item(s), we will issue a refund or replacement(s), whichever is requested and depending upon availability.

Please note that when returning an item, the parcel is your responsibility until it reaches us. We recommend that you ask your Post Office for a proof of posting (available free of charge).

* Excluding artist / artisan goods / jewellery 
 

· Artist / Artisan Goods and Jewellery
Unfortunately due to reasons of hygiene we are unable to offer refunds or exchanges on earrings unless the items are defective / damaged. We are also unable to offer exchange or refunds on any other artist or artisan object or work of art, due to their unique nature, unless they are defective / damaged. These items will be clearly labelled as such on the product item page.

You must notify the De Morgan Centre in writing of any defects within Artist / Artisan Goods and Jewellery within seven days of receipt of your order. If you fail to notify us within the allotted time period, we regret that you will be deemed to have accepted the goods. Goods should then be returned to the DMF (in their original packaging and with all relevant documentation) within 28 days. Once we receive the item(s), we will issue a refund or replacement(s), whichever is requested and depending upon availability.

Please note that when returning an item, the parcel is your responsibility until it reaches us. We recommend that you ask your Post Office for a proof of posting (available free of charge).
 

· Refunds
If you cancel your order prior to dispatch  we will process a full refund as soon as possible. Refunds for unwanted / unsatisfactory or damaged goods will be issued within 30 days of receipt of the returned goods. A refund will be issued for postage paid only when the item is found to be defective or incorrectly supplied from the original order. If you fail to return goods at your expense, DMF reserves the right to charge the direct costs for their recovery and may offset that amount against any refund due.

 

· Limitation of liability
The limit of our liability to you is the making up of any shortfall, replacement, refund of the price of the goods, and, in the case of defective goods, refunding the delivery costs, as provided for in the terms on 'Returns / Replacements / Shortfalls'. We are not responsible to you to any greater extent and in particular we are not liable to you for any indirect or consequential loss (including without limitation financial loss such as loss of profit, or otherwise) which you may incur for whatever reason, as a consequence of our failure to comply with these terms and conditions.
 

· Security
We take the security of all your personal information seriously. However, internet transmissions are never completely private or secure. As this website may contain links to other websites we recommend that you check the privacy and security policies and procedures of all such other websites you visit. You understand that any message or information you send to this website may be read or intercepted by others unless there is a special notice that a particular message is encrypted.
 

·  Choice of law and jurisdiction 
These Terms shall be governed by and construed in accordance with English Law and agree to submit to the non-exclusive jurisdiction of the English courts. De Morgan Foundation is a Charity registered in England and Wales under number 310004. Our contact details are stated below.
